All services to the customer are based on the general terms and conditions outlined below, which underlie all agreements between Guitar Niche and the customer, and are wholly accepted for the duration of the business relationship. If any opposing or deviating conditions exist to the customer, they will only be binding if Guitar Niche has agreed to them in writing.
Guitar Niche has created and designed all artwork contained on this site with inspiration of images in the public domain. These images have been substantial changed, influenced and altered by the artists contracted by Guitar Niche for the purpose of creating high quality artwork. If you believe that any of the artworks contained on this site are in breach of copyright violation please contact us.
By completing an order form on Guitar Niche, customer agrees to enter a binding offer for a contract of sale. Guitar Niche will send an order confirmation via e-mail to the customer. This order confirmation does not represent an acceptance of the offer, but shall only acknowledge to the customer that their order was received by Guitar Niche. The contract is accepted only when Guitar Niche completes shipment of the ordered product to the customer. Guitar Niche reserves the right to reject any received orders for any reason with notice to the customer. The contract ends with the complete delivery to the customer supplied address through Guitar Niche’s shipment provider. If any interruption of delivery occurs, and Guitar Niche fails to provide a congruent substitute transaction in a reasonable timeframe, customer shall be informed immediately. In the event that the customer has already paid Guitar Niche, funds paid shall be refunded.
Goods will be normally shipped within a few days of receipt by Guitar Niche, however delivery may be shipped within 28 days at the latest. Delivery shall be conducted by a shipment service provider chosen by Guitar Niche.
Taxes arising from the transactions Shipping prices from Guitar Niche include taxes arising from the transaction. Shipping and handling are billed separately and shown separately on the invoice. In any event that under statutory regulations the goods are subject to sales or other taxes in the recipient country, these shall be paid additionally upon receipt of the goods by the customer.
Payment will be carried out according to the customer´s choice of either credit card, advance payment or other payment methods. Guitar Niche reserves the right to limit the method of payment chosen by the customer depending on order value, shipment region or other objective criteria. Guitar Niche is entitled to make use of the services of trustworthy third parties for the handling of the payment.
No responsibility is accepted by for any information presented by Guitar Niche. As far as there is a defect in the goods which falls under warranty, the customer shall be entitled to an agreed outcome by both parties; replacement, cancellation, or a reduced price. The term of limitation for claims under warranty for the goods provided is twelve months starting from the receipt of such goods.
Guitar Niche only bears responsibility for damages, no matter what the legal ground, in the case of deliberate action and gross negligence. Guitar Niche.com liability is limited to the payment of the foreseeable, typically occurring damage. As far as liability of Guitar Niche is excluded or limited in these general terms and conditions then the same applies for personal liability related to the order for damages on the part of employees, representatives and agents of Guitar Niche.
Guitar Niche reserves the right to deviate from the descriptions and information contained on our website in respect to material, color, weight, measurements, design or other features, as far as these can be considered reasonable for the customer. Cause for these changes may result from fluctuations customary in trade and technical production processes.
